The session fee covers the photographers time and talent. Session fees taken for any booking are non-refundable except in the event photographer cancels the booking. The Client may cancel a session at any time but in doing so shall forfeit any monies paid. If you or your children are sick, please give 24 hours’ notice to reschedule your session. If 24 hours’ notice is not given or client is a no show, there will be a rebooking fee charged.
Fulfilment of obligations
Photographer shall not be liable to the Client for any failure, in whole or in part, to fulfil her obligations where failure arises as a result of an event or circumstances beyond her control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury. The Client understands and accepts that the photographic coverage will be photographers’ professional expertise determines. Special requests are not binding instructions although every effort is made to comply with the Client’s wishes. In the unlikely event of total photographic failure or cancellation of the contract by photographer liability shall be limited to a full refund of all monies paid.
Your Obligations
You agree to co-operate with us in all matters relating to the Photo Services and to supply us with all information reasonably requested by us in order for us to carry out the Photo Services.
Website Display & Promotional Usage
The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums etc.
The photographer will aim to keep these photographs safe from any malicious activity but cannot be held liable or accountable for malicious actions carried out by persons other than Aleksandra Warchol Photography employees.
There is no guarantee that any particular number of proofs will be produced. Proofs will be available for your in-studio view andvia online gallery and to order within 4 weeks from the date of the session.
All orders are due at this time. Photographer is not obligated to provide the client with any images that are not already presented to them. For all orders, payment is due in full at time of order.
Price of products
Upon booking a session with the photographer please make sure you have fully viewed the price list. It is presumed every Client has read the price list.
Deposit
A non-refundable deposit of £50 or £25 (selected shoots only) (paid by cash, paypal, bank transfer) and £200 for weddings will confirm your booking. By paying the deposit you are agreeing to the terms and conditions laid out in this document. The deposit forms part of the total cost of your Plan (i.e. it is NOT in addition to the cost of the package) and is deducted when calculating the final balance due. The deposit cannot be transferred to other services offered by the photographer. Payment for the balance is due in full at the time of the session or before. Once final payment has been made all monies are non refundable at the discretion of the photographer.
All additional goods must be paid for in full on ordering. This includes extra prints, albums, high resolution digital files,and any other services ordered after the event.
Change of Date
If you need to change the date of the Photo Services then any new date will be subject to the Photographer's availability. We shall use reasonable endeavours to arrange an alternative date for the Photos Services.In the event that we cannot agree another date with you then the deposit will be lost.
Copyright:
The copyright to the images is held by the photographer. You are free: to share – to copy, distribute and transmit the images. Non-commercial – You may not use the images for commercial purposes. No Derivative Works – You may not alter, transform or build upon these images. The Copyright and Design Act 1988 assigns the copyright of the images to the photographers. It is contrary to the Act, and therefore illegal, to copy these images, or allow them to be copied, by any means photographic, by computer, internet or otherwise, by any person or machine other than by the photographers or their appointed agents, unless a royalty-free licence or a reproduction licence has been granted in writing.
Display
The Photographer may display any photographs included in this contract in his/her studio, portfolio, literature, display areas exhibitions, competitions, advertising or slide shows, and websites unless otherwise agreed by the parties involved.
Retouching
The Photographer will retouch, digitally manipulate and finish according to his/her own discretion. Any retouching, digital manipulation or finishing which is requested by the Client(s) may be subject to an extra charge at the discretion of the Photographer.
Judgement
Save as otherwise agreed between the Customer and the Photographer, the Photographer shall be entitled to use his judgement regarding the style and artistic input in the production of Material.
All portraits, books, albums, frames, etc. are non-refundable. Orders cannot be cancelled due to the custom nature of the products. Orders are made to the Client’s personal specification, (i.e. image number, print size, frame style, etc.), the Client does not have the right to a cooling off period. By placing an order with Tracy Willis you are committing to buy the ordered products.
Travel Costs
Locations outside Luton (over 10 miles radius) will be charged 0.40pence per mile. Overnight accommodation may be required for bookings over 100 miles away.
Complaints / Receipt of Goods / Returns
The Photographer must be notified in writing within 7 days of being in receipt of their order in the case of error, shortage or damage, as mistakes cannot be rectified after this period.
Incorrectly supplied items and items of poor quality can be returned and will be replaced at no extra charge to the Client. Returns will not be considered for incorrectly ordered items or items ordered in error.
Should photographs files be lost, damaged or destroyed the photographer(s) liability shall be limited to a pro-rata refund of fees paid, but shall not include a refund for any goods already supplied. No refund will be due for any negatives or digital files lost, damaged, or destroyed after 12 months from the date of the shoot.
Any alterations to orders must be notified either by phone or email and confirmed in writing (sent by Royal Mail special delivery) within three working days of the order being placed. The photographer(s) will not be held liable for any costs incurred due to alterations to the order made by the client after this time. Email is not a reliable method of notification due to the unpredictable operation of message scanners. You must request and receive a confirmation by email if you choose to use this method.
Due to the nature of the product the photographer(s) are unable to give exchanges or refunds. This does not affect your statutory rights.
Cooling off period
All portraits, books, albums, frames, etc are non refundable.Orders are made to the Clients personal specification, (i.e. image number, print size, frame style etc), the Client does not have the right to a cooling off period. By placing an order with the photographer you are committing to buy the ordered products.
Deleted images
All non-purchased images are archived 1 month after your 1-2-1 Viewing. A £25 retrieval fee is charged to re upload any archived Gallery.
Cameras, mobile phone cameras and camcorders are NOT permitted during any session, in Studio or location without express permission from the photographer.
Events & Weddings
The Photographer(s) shall be granted artistic license in relation to the poses photographed and the locations used. The photographer(s) judgment regarding the location, poses and number of photographs taken shall be deemed correct.
Photographs taken during the course of the event will be at the discretion of the photographer(s) although every effort will be made to comply with The Client(s) requirements.
The photographer(s) shall endeavour to photograph all individuals as requested by the client(s) at some point, but no responsibility will be taken by the photographer(s) on the occasion of leaving somebody out.
For a booking involving a church ceremony or at certain venues, the photographer(s) movements are sometimes restricted by the official in charge. The area from which the photographer(s) is able to cover the ceremony may not be the photographer(s) choice and the photographer(s) cannot accept responsibility for any obstructed view should this be the case. The use of artificial lighting may be restricted or prohibited. The photographing of parts or even all of the ceremony may be restricted or prohibited. Client(s) are strongly advised to check with the appropriate official.
For a wedding or other event booking the photographer(s) shall endeavour to capture all the moments throughout the day as they occur. However, because of the fluid nature of the event, some moments might not be recorded, or not recorded for logistical reasons.
